Taction Technology has filed a motion seeking additional payments from Apple after a US jury awarded the company $5.7 billion in a patent-infringement case.

The company is asking for compensation tied to later iPhone and Apple Watch sales, prejudgment interest and further interest until Apple pays. Taction says the jury’s calculation covered sales only through March 2026.

Apple disputes the verdict and has asked the court to overturn it or order a new trial. Apple argues that Taction did not provide evidence supporting the award, leaving jurors to make impermissible large-scale assumptions.

Royalties for newer Apple models

Taction also wants royalties to cover newer devices, including the iPhone 18 Pro, iPhone 18 Pro Max, Apple Watch Series 12 and Apple Watch Ultra 4. It says those products are “not more than colorably different” from the products found to infringe.

To support the request, Taction cites Apple’s earlier patent litigation against Samsung. In that case, Apple argued that royalties should apply not only to products found by a jury to infringe, but also to newer models using essentially the same technology.

Proposed terms for payments

Taction wants Apple to provide quarterly reports of its US device sales and make royalty payments within 30 days after each quarter ends. It proposes a 7% annual rate for prejudgment interest under California law.

The proposed royalties would continue through September 24, 2035, when the patents at issue are scheduled to expire.

The judge has not yet entered the jury’s verdict as a final judgment. The original award, Taction’s additional demands and Apple’s request for a reversal or retrial therefore remain unresolved.
