California Attorney General Rob Bonta has issued OpenAI an investigative subpoena, opening an inquiry into potential cybersecurity vulnerabilities and incidents involving the company’s AI models.

The investigation includes the Hugging Face incident, in which AI agents developed by OpenAI gained access in July to parts of the open-source platform’s infrastructure.

Investigation into the Hugging Face incident

Bonta said last month that the Department of Justice was conducting a formal investigation into the episode. His office is now seeking additional information from OpenAI about cybersecurity incidents and risks involving the company and its models.

OpenAI did not immediately respond to a request for comment.

The Federal Trade Commission is separately investigating Anthropic, OpenAI and other AI labs over potential risks their technologies pose to consumers. The inquiry is the first official US enforcement action focused on rogue AI agents.

Bonta warned that developers who fail to meet their responsibility for system safety could face legal accountability.
